Any Learner's Tutor Terms of Service Agreement

This Terms of Service Agreement (“Agreement”) is a legally binding contract between AnyLearnersTutor (“we,” “us,” or “our”) and you, the user (“User” or “you”), governing your use of our website and related services. By accessing or using our platform, you agree to abide by these terms and conditions. If you do not agree with any part of this Agreement, please do not use our services.
1. Registration
1.1. User Account: To access certain features of our platform, you must create an account. You agree to provide accurate and complete information when registering and to keep your account information up to date.
1.2. Security: You are responsible for maintaining the security of your account credentials. You must not share your account information with others. Any activity occurring under your account will be your responsibility.
2. Booking and Appointments
2.1. Appointment Scheduling: Our platform allows Users to schedule appointments with tutors. Appointments are subject to availability.
2.2. Zoom Usage: Appointments will be conducted using Zoom. You agree to abide by Zoom’s terms of service and privacy policy when using their services for appointments.
2.3. Cancellation Policy: Cancellations can only be made as outlined in Section 11 of these Terms of Service..
3. Subscription Membership
3.1. Subscription Access: Certain sections of our platform may require a subscription membership, granting access to additional learning materials and resources. Subscription fees are non-refundable.
3.2. Termination: We reserve the right to terminate or suspend subscription memberships for violation of our terms or for any other reason deemed necessary.

4.1. Contact Us: For any inquiries, support requests, or cancellations, please use the contact us form on our platform.
5. Privacy Policy
5.1. Your use of our platform is also governed by our Privacy Policy, which can be found at www.anylearnerstutor.com/privacy-policy/. By using our platform, you consent to the collection and use of your information as described in our Privacy Policy.
6. Disclaimers and Limitations
6.1. Use at Your Own Risk: Your use of our platform is at your own risk. We do not guarantee the accuracy, reliability, or availability of our services, tutors, or materials.
7. Termination
7.1. Termination: We may terminate or suspend your account or access to our platform at our discretion, without prior notice, for any violation of this Agreement or for any other reason.
8. Governing Law and Dispute Resolution
8.1. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of British Columbia, Canada.
8.2. Dispute Resolution: Any disputes arising under this Agreement shall be resolved through arbitration in accordance with the rules of the Canadian Arbitration Association.
9. Changes to the Agreement
9.1. Modification: We reserve the right to modify this Agreement at any time. We will notify Users of significant changes, and your continued use of our platform after such changes constitutes acceptance of the modified terms.
10. Refund Policy
10.0. Cancelled Appointments: Users will be refunded the full amount paid if the appointment is cancelled in accordance with Section 11 of the Terms of Service. The method of refund may be determined by Any Learner’s Tutor on a case-by-case basis.
10.1. Subscriptions: Subscriptions to our services are non-refundable.
10.2. Ask A Tutor Service: Payments related to this service are only refundable up when the question is answered, at which point the payment becomes non-refundable.
10.3. Method of Refund: The method of refund may be determined by Any Learner’s Tutor on a case-by-case basis.
10.4. Exceptions: We reserve the right to make exceptions to this policy in special circumstances, such as emergencies or extenuating circumstances, at our sole discretion.
11. Cancellation Policy
11.1. Cancellation Period: Users are allowed to cancel appointments up to 24 hours before the scheduled time without incurring any cancellation fees.
11.2. Late Cancellation: Cancellations made within 24 hours of the scheduled appointment may result in a cancellation fee, the amount of which will be the same value as the scheduled appointment.
11.3. No-Show Policy: Failure to attend a scheduled appointment without prior notice will result in a no-show fee, the amount of which will be the same value as the scheduled appointment
11.4. Refunds: Refunds for cancelled appointments will be issued in accordance with our refund policy, as outlined in Section 10 of this Terms of Service agreement.
11.5. Rescheduling: Users may have the option to reschedule appointments 24 hours prior to their appointment time, subject to tutor availability and any applicable rescheduling fees.
11.6. Tutor Rescheduling and Cancellations: At any time our tutors can cancel your appointment or reschedule it to a new date and time agreed upon with the user. If the appointment is rescheduled by a tutor within 24 hours of the original start time, the tutor has the right to offer a discount of their choosing to the user. If the appointment is cancelled by a tutor within 24 hours of the original start time, the tutor will offer a full refund.
11.7. Notification: Users must notify us of cancellations through the appropriate channels provided on our platform, such as the booking system or the contact form.
11.8. Exceptions: We reserve the right to make exceptions to this policy in special circumstances, such as emergencies or extenuating circumstances, at our sole discretion.
